Terms of Service

By accessing the Platform you confirm that you are at least 18 years old, capable of entering into a binding contract under the Indian Contract Act, 1872, and not barred from doing so under any applicable law. These Terms apply to every visit and every transaction you make on the Platform.

AdsKart publishes this electronic record under Section 10 of the Information Technology Act, 2000 and Rule 3(1) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. No physical or digital signature is required.

• You must register with accurate, current and complete information and keep it updated.
• One person may maintain only one active account. Business accounts must clearly identify the underlying entity.
• You are responsible for everything that happens under your account. Keep your password and OTPs confidential and do not share access with anyone else.
• Tell us immediately at support@myadskart.com if you suspect unauthorised access to your account.
• We may suspend or terminate accounts created with false information, used by under-18 users, or otherwise in breach of these Terms.

• List only items you own or are legally authorised to sell.
• Provide accurate titles, honest descriptions, genuine photographs and a fair price.
• Categorise the listing correctly and post it only once. Duplicate or cross-category postings will be removed.
• Do not include personal contact details (phone, email, social handles) inside the listing description — use the in-app chat. We may automatically redact contact details to protect users from spam and fraud.
• AdsKart may edit, re-categorise or remove listings that breach these guidelines and, in serious cases, suspend the seller’s account.

The following are not permitted on the Platform. This list is illustrative, not exhaustive — we may prohibit other items at our discretion to keep the Platform safe and lawful.

• Goods or services whose sale is restricted under Indian law (firearms, ammunition, explosives, narcotic drugs, psychotropic substances, tobacco, alcoholic beverages, lottery tickets, betting and gambling services).
• Counterfeit, replica or stolen goods; goods bearing forged trademarks; or goods sold in breach of someone else’s intellectual property.
• Human remains or body parts, organs, blood, bodily fluids, and live animals or pets (except where regulated re-homing is permitted).
• Adult content, sexual services, escort services, or content that sexualises minors.
• Hateful, harassing, abusive, defamatory, or threatening content; content that promotes terrorism, violence or self-harm.
• Recalled products, products without mandatory BIS / ISI certification, hazardous chemicals, prescription medicines, medical devices requiring registration, used cosmetics and used underwear.
• Currency, securities, foreign exchange, digital assets, vouchers and gift cards offered as the primary item of sale.
• Government identity documents, official badges, and items obtained from public services (PDS ration, subsidised LPG cylinders, etc.).
• Multi-level marketing programs, pyramid schemes, get-rich-quick offers and any service that promises guaranteed returns.
• Spam, automated postings, and listings that exist primarily to drive traffic to external sites.

AdsKart is a venue. We are not the buyer or seller of any item listed on the Platform and we do not take possession of items or money exchanged between users.

• Sellers are responsible for the lawfulness, accuracy, quality and condition of items they list, for handing over the item, and for paying any taxes that apply.
• Buyers are responsible for evaluating items before paying, for the legality of the purchase, and for complying with applicable taxes and import rules.
• Always meet in safe, public places. Never share OTPs, UPI PINs, card CVVs or banking passwords with anyone — AdsKart will never ask for them.
• Disputes between buyer and seller are resolved between them. We may, at our sole discretion, mediate or remove listings, but we are not a party to the underlying transaction.

When you use the Platform you agree not to:

• harass, threaten, dox, impersonate or stalk other users;
• publish content that infringes anyone’s privacy, intellectual property or other legal rights;
• circumvent any technical measure that limits access to or use of the Platform;
• use bots, scrapers, or automated tools to access, copy or modify the Platform without our written permission;
• upload malware, phishing links, or content that disrupts the Platform; or
• use the Platform in any way that violates applicable laws of India.

• Premium packages, featured listings and other paid services are charged in Indian Rupees and processed by PhonePe.
• Prices on the Platform are inclusive of applicable GST unless stated otherwise. We will issue you a tax invoice for each purchase.
• Paid services activate immediately on successful payment and are non-refundable once activated, except where the law requires a refund or where AdsKart is unable to deliver the service due to a fault on our side.
• If a transaction fails but your account is debited, the amount will be reversed by your bank or PhonePe within standard banking timelines (typically 5–7 working days). Write to billing@myadskart.com if it isn’t.
• Unused ad slots and bonus credits do not roll over after the package expires unless we say so in writing.

Promotional codes are personal, non-transferable, valid only for the period stated, and may be withdrawn or revalued at any time before they are applied. Featured listings give you increased visibility within a category or region for the period purchased; the exact placement algorithm is determined by AdsKart and may change.

The AdsKart name, logo, software and design are owned by AdsKart and protected under Indian and international intellectual-property laws. You may use the Platform only as permitted by these Terms. By posting content (text, photos, video) you grant AdsKart a non-exclusive, royalty-free, worldwide licence to host, display and distribute that content for the purpose of operating the Platform.

If you believe content on the Platform infringes your intellectual-property rights, send a notice to copyright@myadskart.com containing: (a) your contact details, (b) a description of the work that has been infringed, (c) the exact URL(s) of the infringing material, (d) a good-faith statement that the use is not authorised, and (e) a statement under penalty of perjury that the information is accurate and you are authorised to act on the owner’s behalf. We will remove or disable access to the content within 36 hours of receiving a complete notice and notify the user who posted it, who may submit a counter-notice.

Your use of the Platform is also governed by our Privacy Policy. By using the Platform you consent to the collection and use of your information as described there.

The Platform may contain links to or embeds from third-party services — for example Google AdSense advertisements, PhonePe payment pages, or YouTube videos linked from listings. AdsKart does not control these third parties and is not responsible for their content, privacy practices or availability.

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ADSKART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT LISTINGS POSTED BY OTHER USERS ARE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADSKART AND ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO ADSKART FOR PREMIUM SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 5,000, WHICHEVER IS HIGHER.

You agree to indemnify and hold AdsKart and its directors, officers, employees and agents harmless from and against any claim, demand, loss, liability, damage, cost or expense (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Platform, (b) any content you post, (c) your breach of these Terms or our Privacy Policy, or (d) your violation of any law or third-party right.

You may close your account at any time from Settings. We may suspend or terminate your access to the Platform — with or without notice — if we reasonably believe that you have breached these Terms, that your account is being used to defraud or harm other users, or that continued access poses a risk to the Platform. On termination, certain provisions of these Terms (including those relating to intellectual property, disclaimers, liability and indemnification) will survive.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to the next paragraph, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over any dispute arising under or in connection with these Terms.

Before initiating legal proceedings, the parties will attempt in good faith to resolve any dispute by negotiation. If negotiation does not resolve the dispute within 30 days, the dispute shall be referred to a sole arbitrator appointed by AdsKart in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Hyderabad, and proceedings shall be conducted in English.

We may update these Terms from time to time. When we make material changes we will notify you through the Platform or by email at least 7 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. The “Last updated” date at the top of the page always reflects the current version.
